The purpose of this regulatory directive is to advise registrants and other interested groups and agencies of revisions to Regulatory Directive Dir93-16, Registration Requirements for Electrical Devices Intended for the Control of Flying Insect Pests. This revised regulatory directive more accurately reflects the current regulatory status of this type of control product.

This Regulatory Directive replaces Dir93-16, dated October 28, 1993

Devices Subject to Regulation

All devices listed in Schedule I of the Pest Control Product Regulations (PCP Regulations), including devices for the control of flying insects, are subject to regulation under the Pest Control Products Act (PCP Act).

Devices Exempt from Registration

Section 5 (1) (c) (i) of the PCP Regulations allows exemption from registration of specific kinds and types of products, provided they meet all the applicable conditions set out in Schedule II of the PCP Regulations. Although not required to be registered, these products remain under the authority of the PCP Act and are subject to routine enforcement programs.

Electrical Devices Intended for the Control of Flying Insect Pests

For a device that is manufactured, represented, or sold as a means to attract and destroy flying insects by means other than use of a chemical active ingredient, the conditions for exemption from registration are as follows:

  1. The device has been certified by the Canadian Standard Association under CSA Standard C22.2 No.189-1979, High-Voltage Insect Killer, dated June, 1979, to conform to that Standard; and
  2. The label of that device must provide the following information:

    1. the symbol or design of the Canadian Standards Association,
    2. the identity of the device in terms of its function,
    3. the name and postal address of the Canadian Agent or distributor.
    4. the directions for the use of the control product, including time of application and use limitation.
    5. Information identifying any hazards respecting the handling , storage, display, distribution and disposal of the control product, including instructions respecting procedures to alleviate the hazards.
    6. Information identifying any hazards to
      1. things on or in relation to which the control product is intended to be used; and
      2. public health, plants, animals or the environment.
    7. Instructions respecting procedures to alleviate the hazards referred to in paragraphs (6) (a) and (b).
  3. A device intended for use indoors must provide the following additional information on the label:

    1. the statement of precaution "This device should not be installed directly over surfaces where food is exposed, processed or prepared.", and
    2. the statement "To aid in the reduction of house-fly population, use this device in conjunction with sanitary practices.".
  4. A device intended for use outdoors, must provide the following additional information on the label:

    1. the words "For Outdoor Residential and Recreational Use.",
    2. the words "This device does not control black flies, mosquitoes or other biting flies.".
